1. About these terms

These Terms & Conditions (“Terms”) are a legal agreement between you (“you”, “the client”) and Luchi Empire (“Luchi Empire”, “we”, “us”, “our”), a Ghanaian group of businesses based at Atadeka Lorry Station, Ashiaman, Greater Accra. They govern your use of luchiempire.com (“the website”) and any service, quotation, booking or work provided by our divisions: Construction, Software Engineering, Transport, Travel & Accommodation, Beauty Therapy and Risk Management.

Individual engagements may also be covered by a separate written contract, scope of work, quotation or booking confirmation. Where such a document conflicts with these Terms, that document takes precedence for that engagement.

2. Use of the website

The website is provided for general information about Luchi Empire and its services. Content may be updated or changed at any time without notice. While we take care to keep information accurate, we make no warranty that it is complete, current or free from error, and it should not be relied on as professional advice on its own.

You agree not to use the website unlawfully, to attempt to gain unauthorised access to it, or to copy, republish or exploit its content without our written permission.

3. Quotations, bookings and pricing

Quotations and estimates are valid for the period stated on them, or for 30 days where no period is stated, and are subject to a site visit, survey or confirmation of availability. Prices may change where the scope of work changes, where third-party costs (materials, fares, room rates, government fees, exchange rates) change, or where information provided to us proves to be inaccurate or incomplete.

A booking, project or job is only confirmed once we have accepted it in writing and, where applicable, received the agreed deposit or payment.

4. Payment

Unless agreed otherwise in writing, payment terms are as stated on the quotation, invoice or booking confirmation. Deposits are used to secure dates, materials or third-party reservations and may be non-refundable to the extent that we have already committed those funds on your behalf. We reserve the right to suspend or stop work, or to release a booking, where payment is overdue.

5. Your responsibilities

You agree to give us accurate and complete information, to provide timely access, approvals, permits and decisions where these are needed, to hold the necessary permissions for any property or project, and to comply with all applicable laws. Delay or loss caused by inaccurate information or late input from you is not our responsibility, and may affect price and timescale.

6. Travel & Accommodation and Tours — advisory service disclaimer

In particular:

• Our recommendations are given in good faith based on the information available to us at the time. Final choices, and the decision to travel, rest with you.
• We are not liable for the acts, omissions, delays, cancellations, overbooking, schedule changes, closures, service quality, loss, damage, injury, illness or death arising from any third-party provider.
• Prices, fares, room rates, taxes and availability are set by third parties and can change until a booking is issued and paid in full. Third-party cancellation, amendment and no-show charges are passed on to you.
• Visa, entry, transit and immigration decisions are made solely by the relevant authorities. We can help prepare and lodge an application, but we cannot guarantee that a visa or entry will be granted, or any processing time.
• You are responsible for holding a valid passport and any required visas, permits and vaccinations, and for meeting the entry and health requirements of every country on your itinerary.
• We strongly recommend comprehensive travel insurance covering medical care, cancellation, curtailment, personal belongings and repatriation. Travel is undertaken at your own risk.
• Itineraries, tours and activities may be changed or withdrawn for reasons of safety, weather, operational need or events outside our control.

Where you pay us for a third-party booking, we act as your booking agent and remit those funds to the provider. Our own liability is limited to the service fee charged by Luchi Empire for arranging the booking.

7. Other divisions

Construction. Work is carried out to the agreed scope, drawings and applicable Ghanaian building standards. Variations must be agreed in writing. Warranties, where offered, are stated in the project contract and exclude fair wear and tear, misuse, third-party alteration and lack of maintenance. Sale-of-land transactions are subject to separate documentation and due diligence.

Software Engineering. Deliverables, milestones and acceptance criteria are defined per project. Unless stated otherwise, third-party software, hosting, licences and APIs are your responsibility and are governed by their own terms. Post-launch support is provided only under a written support or maintenance agreement.

Transport. Work-and-pay, driver-placement and fleet-management terms are set out in the relevant vehicle or service agreement. Drivers we place are vetted to the standard agreed with you; day-to-day supervision, insurance and lawful use of a vehicle remain the responsibility of its owner or operator.

Beauty Therapy. Please tell your therapist about allergies, skin conditions, medication or pregnancy before any treatment. Treatments carry inherent risks and results vary between individuals. A patch test is advised for chemical services. Services are provided by appointment; late arrival may shorten a treatment.

Risk Management. Health, safety, security and environmental advice, training and audits are advisory. Implementing recommendations, maintaining compliance and meeting statutory duties remain the responsibility of the client organisation and its officers.

8. Intellectual property

The website and its content — text, graphics, logos, the Luchi Empire name and the “you will be smiling” slogan, images and layout — are owned by Luchi Empire or its licensors and are protected by law. Third-party photography is credited on the image credits page. Ownership of project deliverables passes to the client only as set out in the relevant contract and typically on full payment.

9. Third-party links

The website and our communications may link to third-party sites and services. We do not control them and are not responsible for their content, availability or practices. A link is not an endorsement.

10. Disclaimers and limitation of liability

Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot lawfully be limited under the laws of Ghana.

Subject to that, the website and our information are provided “as is” without warranties of any kind. To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, data, business or goodwill, or for the acts or omissions of third-party providers. Our total liability arising out of or in connection with any engagement is limited to the fees paid to Luchi Empire for that engagement.

11. Indemnity

You agree to indemnify Luchi Empire against claims, losses and costs arising from your breach of these Terms, your misuse of the website, or inaccurate information you provide to us.

12. Force majeure

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including natural events, fire, flood, epidemic or pandemic, war or civil unrest, strike, failure of utilities or telecommunications, government action, border or airspace closure, or third-party provider failure.

13. Privacy

Information you send us — by the enquiry buttons, email or WhatsApp — is used only to respond to your enquiry and to provide the service you ask for. We do not sell your personal information. Our Privacy Policy explains what we collect, how we use and share it, how long we keep it and your rights.

14. Changes to these terms

We may update these Terms from time to time. The version published on this page at the time you use the website or engage a service is the version that applies. Please check back periodically.

15. Governing law

These Terms and any dispute arising from them are governed by the laws of the Republic of Ghana, and the courts of Ghana have exclusive jurisdiction.
